Ohio Court of Appeals,
2024 Ohio 6051,
filed December 27, 2024
In this case involving a marital dissolution,
the Court held that an option to repurchase
shares from other shareholders had no value
as there was no intention to exercise the
option. The Court also, on remand to
the trial court, had the trial court consider
whether or not the valuation depended on by it
took into consideration the cost of growth and
net income projections and whether or not that
valuation contained a discount for lack of
marketability.
